On 3 June 2023, the Act of 9 May 2023 amending the Act on Management of Agricultural Property of the State Treasury, the Act – Construction Law and the Railway Transport Act (Journal of Laws of 2023, item 967) (hereinafter: the ‘Amending Act’ or the ‘Amendment’) entered into force, constituting the next legislative stage aimed at streamlining the investment and construction process.
Legislative postulates aimed at increasing the efficiency of construction:
(i) the introduction of a nationally uniform System of Administrative Procedure in the Construction Industry (SOPAB),
(ii) launch of a digital, fully free Construction Project Database,
(iii) reduction of the paper documentation burden on the bodies of architecture and construction administration, construction supervision and Investors,
(iv) introduction of 100% electronic circulation of documentation in the area of construction in public administration.
Important demands introduced by the Amendment Act:
(i) the parameters of aboveground bulk material silos were increased in accordance with the parameters indicated in Article 29(1)(29)(C) of the Construction Law,
(ii) notification of the construction of one-storey farm buildings and sheds of simple construction related to agricultural production in accordance with the parameters indicated in Article 29(1)(32) of the Construction Law,
(iii) notification of the construction of grain storage buildings within the boundaries of seaports in accordance with Article 29(1) para. 32 of the Construction Law,
(iv) no requirement to obtain a building permit or submit a notification for the construction of one-storey farm buildings and sheds serving agricultural production in accordance with Article 29(2)(33) of the Construction Law,
