On November 17, 2003, the Act of 23 July 2003 on the protection and care of historical monuments (Journal of Laws 2003, No. 162, item 1568) (hereinafter: ‘the Act’) came into force and remains in force to this day. Due to the excessive workload of provincial offices for the protection of historical monuments and other accompanying circumstances paralysing the effective protection of historical monuments, legislative works on the amendment of the Act were started.
Consequently, a bill was passed on 13 July 2023 on amending the Act on the protection and care of historical monuments (Journal of Laws 2023, item 1904) (hereinafter: the ‘Amendment Bill’ or the ‘Amending Bill’).
The Amending Bill provides for the following legislative solutions:
(i) some of the matters requiring conservation permits shall be replaced by notifications, thus streamlining the historic preservation procedure,
(ii) targeted subsidies also for monuments included in the register of monuments,
(iii) the obligation to label a monument as real estate,
(iv) legal basis for the transfer of the decision to another entity,
(v) modification of interim protection against entry into the Registry of Cultural Property.
The Amending Bill shall enter into force on 1 May 2024.
